Terms of Service
1. Acceptance
By using SwiftCall, you agree to these Terms. If you do not agree, do not use the service. These Terms apply to all users, including clients accessing the portal.
2. Service Description
SwiftCall provides AI-powered communication agents that handle phone calls, WhatsApp, SMS, Telegram, and web chat on behalf of your business. The service includes AI-generated responses, appointment booking, call routing, CRM integration, and analytics.
3. Account & Responsibilities
You are responsible for maintaining the security of your account credentials, ensuring you have the legal right to process data of individuals your agent communicates with, obtaining necessary consents for call recording, and complying with applicable laws in your jurisdiction.
4. AI Disclosure
SwiftCall AI agents are clearly identified as artificial intelligence in compliance with the EU AI Act (Article 50). Users of your agent will be informed they are communicating with AI, not a human.
5. Billing & Payment
Pricing is in EUR, billed monthly via Stripe. Subscriptions renew automatically. You may cancel at any time; access continues until the end of the billing period. We provide 30 days notice of price changes.
6. Free Trial
The 14-day free trial requires no credit card. At the end of the trial, the service pauses until a subscription is activated. No data is deleted during the trial period.
7. Intellectual Property
You retain ownership of your data and conversation content. SwiftCall retains ownership of the platform, software, AI models, and documentation. You receive a limited, non-exclusive license to use the service.
8. Acceptable Use
You may not use SwiftCall for: illegal activities, harassment or spam, impersonating real people without consent, processing children's data without parental consent, or attempting to reverse-engineer the platform.
9. Service Availability
We target 99.7% uptime but provide the service "as-is" without guarantees of uninterrupted operation. AI responses may not always be accurate; you are responsible for reviewing critical communications.
10. Limitation of Liability
SwiftCall's total liability is limited to the amount paid in the preceding 12 months. We are not liable for indirect, consequential, or incidental damages. This does not limit liability for GDPR violations or willful misconduct.
11. Termination
Either party may terminate with 30 days notice. Upon termination, your data is retained for 30 days for export, then deleted. SwiftCall may terminate immediately for Terms violations or non-payment.
12. Governing Law
These Terms are governed by Romanian law. Disputes are resolved first through good-faith negotiation (30 days), then through the courts of Bucharest, Romania. Consumer complaints may also be filed with ANPC.
13. Changes
We may update these Terms with 30 days email notice. Continued use after the notice period constitutes acceptance. If you disagree, you may terminate your account.
